The Digital Services Act (“DSA”) entered into force in the European Union (“EU”) on November 16, 2022.
Under Article 24(2) of the DSA, online platforms are required to publish information on the average monthly active recipients of their service in the EU at least once every six months. This is for the purpose of determining whether an online platform is a “Very Large Online Platform” (“VLOP”), which the DSA defines as having at least 45 million monthly active users in the EU. VLOPs are subject to additional requirements under the DSA.
Snowflake confirms that the average number of monthly active recipients of its online platform service, the Snowflake Marketplace, for the period February 1, 2024 to July 31, 2024 in the EU was below 45 million. As such, Snowflake remains below the threshold for VLOP designation. This number has been calculated in accordance with the relevant provisions of the DSA and the Guidance published by the European Commission on February 1, 2023.
